This is a complex question that absolutely warrants a conversation with a skilled Texas family law attorney. In general, you do not have a right to custody of your stepchild if you have not adopted them. In some cases, however, you may be able to seek visitation. And if the biological parent is unfit or incarcerated, you may even be able to get custody. Talk to a lawyer. Don’t try to litigate this on your own.
