That depends on several factors. You can file and say the marriage is irretrievably broken if you do not want to cite adultery. If you do want to file because of adultery, however, you’ll need evidence–especially if you plan to seek a more favorable disposition because of the adultery. In general, courts are often willing to give more to spouses who were cheated on, especially if the cheating or other behavior in the marriage was very egregious.
