Yes and no. You can certainly file, and can even seek a temporary order. But most judges will not grant a divorce while pregnant, for one simple reason: you’ll be back in court in a few months fighting about custody and child support. So consider working out division of property now, and discussing options for child custody. If you can come to an agreement, you may be able to file a voluntary order as soon as the baby is born. Otherwise, you’ll need to fight over custody then, since courts don’t issue custody orders until the birth of a child.
