To claim abandonment, your spouse has to have been gone for a year. That doesn’t mean you have to wait that long. If you just want a divorce, you can file now and claim that the marriage is irretrievably broken. Whether you file now or later, and claim abandonment or don’t will not affect your eligibility for child support, and should not affect division of property.
